BLFTV (the “Company”“we”) understands that your privacy is important to you and that you care about how your information is used and shared. We respect and value the privacy of everyone who takes part in our programmes, employed by the Company visits our website and submits enquiries, and we will only collect and use information in ways that are useful to you and in a manner consistent with your rights and our obligations under the law.
 
This Privacy Policy explains what personal data (the “Information”) we will hold about you, how we collect it, and how we will use and may share information about you when you provide contributions or enquiries to us. This is intended for individuals who provide contributions to our productions (such as actors, musicians, presenters, writers and composers) and other contributors providing contributions to us (such as interviewees or those providing material like photos or the use of their property as a filming location). It also applies to individuals who have previously contributed to our productions and to those who may have submitted any enquires online or email communications (eg: casting enquiries or job applications).

This section covers policies by the Company with regard to data protection and the rights of website users (“data subjects”) in respect of their personal data under the Data Protection Act 1998 (“the Act”).

3.2       HOW WE USE YOUR INFORMATION (DATA PROTECTION)

All personal Information that we may collect (including, but not limited to, your name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and your rights under that Act.


Any and all personal data and information collected by the Company is collected in order to ensure that the Company can provide the best possible service and can work effectively with its partners, associates and affiliates and efficiently manage its employees, contractors, agents and consultants.

The Company may also use personal data in meeting certain obligations imposed by law.


Certain data that may be collected by the Company, such as IP addresses, certain information gathered by cookies, pseudonyms and other non-identifying information may nonetheless be collected, held and processed to the same standards as personal Information.


By submitting your details via an enquiry on our website or through email, we automatically request that you give us permission to contact you in future regarding any services that we feel may be of interest to you. 

If you do not supply us with permission to retain your information in accordance with GDPR policies, we remove and delete your details from our systems routinely.


If you have agreed to the Company retaining your Information, we may hold it for as long as is deemed necessary and use it to provide our goods and services to you, inform you of new products and employment or on-screen opportunities within the company. 

You may request that we stop sending you this information at any time.

As part of a contribution for any of our programmes, you provide certain additional information to us. This could be your image, voice, photos of yourself, views of your property and other information contained in your contribution that identifies you.

 
You also provide information in your contract with us and any other correspondence with us concerning your contribution, including your name, email address and address. If we pay you for your contribution, you may provide us with your banking details.

 
We process your information for the purposes of our business, including for production, broadcasting, distribution and marketing.


If you are a contributor to any of our programmes, we may share your information internally within our group to those employees working on your production. Your information may also be seen by managers and administrators (including, for example, our finance team) for purposes of production, broadcasting, distribution, marketing, administration, and management.

 
We will only share your information with third parties outside our group where disclosure is consistent with a legal basis for processing on which we rely and where this is lawful and fair to you. We may disclose your information if it is necessary for our legitimate interests or the interests of a third party but will not do this if these interests are overridden by your interests and rights to privacy.


Specific circumstances in which your information may be disclosed include:

·      Disclosure to external recipients of electronic communications (such as emails) which contain your information.

·      Disclosure of aggregated and anonymised diversity data to relevant regulators as part of a formal request.

·      If you have an on-screen role, disclosure of footage, images, or audio recordings of you as part of the broadcasting, distribution, and marketing of the production. Or, whether you have an on-screen or off-screen role, to allow us to credit your role.

 
As a data controller, we are required to have a legal basis for processing your personal data. We will use the information we collect about you for:

·      The performance of the contract and relationship between you and us.

·      Financial planning and budgeting.

·      Contacting you (or others on your behalf, such as your agent) in connection with your contribution in our productions.

·      Enabling the creation, sale, and distribution/broadcast of a production you are taking part in.

·      Contacting you in relation to opportunities to contribute on further productions we may be working on.

·      This includes processing of your contact information.

·      Monitoring of diversity and equal opportunities.

·      Disputes and legal proceedings.

·      Day to day business operations including marketing and travel on our behalf (where relevant).

·      Maintaining appropriate business records during and after your participation in a programme.


3.3       DATA BREACHES

We implement reasonable precautions and follow industry best practices to protect your information and ensure that such Information is not accessed, disclosed, altered, or destroyed.  However, these measures do not guarantee that your Information will not be accessed, disclosed, altered, or destroyed by breach of such precautions. By agreeing to our Privacy Policy, you acknowledge that you understand and agree to assume these risks.

We will report any unlawful data breach of this website’s database or the database(s) of any of our third-party data processors to all relevant persons and authorities after the breach if it is apparent that personal data stored in an identifiable manner has been stolen.


3.4       DATA SUBJECTS

Data subjects have the right to access a copy of their personal Information held by the Company by means of a Subject Access Request (“SAR”), which will incur a charge.


Data subjects may object to any processing of his or her personal data that is likely to cause (or that is causing) damage or distress. Data subjects should make any such objection in writing to customer services by emailing hello@biglittlefish.tv and the Company shall respond within 21 days either notifying the data subject of its compliance, or explaining why the Company feels that any aspect of the data subject’s request is unjustified.
 
A data subject may make a SAR at any time to find out more about the Information which the Company holds about them. SARs should be made in writing, addressed to hello@biglittlefish.tv and will incur a processing fee of £12.00.


3.5       IMPLEMENTATION OF THIS POLICY 

This Policy shall be deemed effective as of October 3, 2019 (last updated June 2020).

 
No part of this Policy shall have retroactive effect and shall thus apply only to matters occurring on or after this date. If any of these terms and conditions are found to be invalid, then that provision shall not affect the validity of the remaining provisions which remain fully enforceable. The company may review or change the terms and conditions of their policies at any time and without warning.
